These Terms of Service ("Terms") govern your access to and use of Devana, an AI-powered mock technical interview platform operated by Devana ("we," "our," or "us"). By creating an account or using our services, you agree to be bound by these Terms.
You must be at least 16 years old to use Devana. By using our platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

The Free plan provides limited access to our platform at no cost. We reserve the right to modify the features and limits of the free plan at any time. Your interview reports and session history are kept and available on every plan, including Free.
Devana, its AI models, interview questions, scoring algorithms, coaching content, and all associated intellectual property are owned by us or our licensors. You may not copy, modify, distribute, sell, or lease any part of our services.
You retain ownership of the code you write during interview sessions. By using Devana, you grant us a limited, non-exclusive license to process your code and responses for the purpose of providing feedback, scoring, and improving our AI models.
The feedback, scores, and coaching recommendations provided by Devana are generated by AI and are for educational and practice purposes only. We do not guarantee:
Devana groups practice questions by company name, for example "Google" or "Stripe". This describes the kind of question we expect that company to ask. It does not mean the question came from them.

Where users share questions they report having been asked, we treat those as user submissions under section 5.2 and use them as signal about interview trends. We do not publish them as verified accounts of any company's process.
The creator program lets approved participants earn commission for referring new paying customers. These terms apply in addition to the rest of this document.
Applications are reviewed by hand and we may accept or decline any application at our discretion. A creator account is separate from a Devana user account and gives no access to one. You must confirm your email address before your application is reviewed.
Approved creators earn 40% of the first payment made by each new customer who subscribes through their referral link. Commission is earned once per customer. Renewals, upgrades and any later payment by the same customer earn nothing further.
Commission is calculated on the plan price actually paid, excluding any taxes or payment processing fees. We may change the commission rate for future referrals with reasonable notice; commission already earned is not affected.
A click on a referral link is recorded in the visitor browser for 30 days. If that person creates an account within that period, the account is attributed to the creator permanently, and a later payment earns commission regardless of how much time has passed or which device is used.
Attribution depends on the visitor browser retaining the record. We cannot attribute a referral where the person signs up on a different device, clears their cookies, blocks them, or signs up more than 30 days after clicking. Where more than one referral link is clicked, the most recent one is credited. Customers who already hold a Devana account cannot be referred.
Our records of clicks, signups and commission are the authoritative record for the program.
Commission is held for 14 days after the customer payment and then becomes withdrawable. Creators may request a payout once their cleared balance reaches 50 US dollars. Payouts are made manually to the payment details provided by the creator, and we are not responsible for money sent to incorrect details a creator has supplied.
Where a referred payment is refunded or charged back, the related commission may be reversed, including after it has cleared.
You must disclose that your link is an affiliate link wherever required by the platform you post on or by applicable law. You must not bid on our brand name in paid search, impersonate Devana or its staff, present yourself as an employee, use our name in a domain or account handle in a way that suggests you are us, or make claims about the product that are not true, including guarantees of interview or job outcomes.
You must not refer yourself, create accounts in order to generate commission, use spam, unsolicited messaging, misleading claims, coupon or cashback stuffing, automated traffic, or any method that inflates clicks or signups artificially. Commission arising from any of these earns nothing and may be reversed.
We may suspend or remove a creator from the program at any time, in particular for breach of this section. A suspended creator link stops attributing immediately and they lose access to the creator dashboard. Commission already cleared remains payable. Either party may end participation at any time; commission already earned and cleared remains payable, and pending commission may be withheld where we reasonably believe this section has been breached.
Participation in the program does not create an employment, partnership, agency or joint venture relationship. Creators are responsible for their own taxes on any commission they receive.
Your use of Devana is governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
DEVANA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEVANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OUR SERVICES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Devana and its officers, directors, and employees from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.
We may modify these Terms at any time. We will notify registered users of material changes via email at least 30 days in advance. Continued use of Devana after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
